Tom Brady & Gisele Bündchen Lacked A Key Trait Needed To Prevent Divorce — And Not Even Retirement Could Change It

The media is always abuzz when the name Tom Brady comes into play.  When Tom retired in 2022 and said he “needed to spend time with his family” and then shortly unretired and came back amidst rumor and speculation that also included he was having “marital difficulties” as a result of unretirement, many people looked to blame his wife Gisele as the cause of his stress and turmoil.

However, the bottom line is that a couple (whether it be in a marriage or a committed relationship) has to be on the same page with respect to commitment, what is important to each person, and shared responsibilities. 

Based upon what was rumored and said in the media, it doesn’t appear that Tom and Gisele were on the same page for many years.

Everyone knows that a full-time job/career takes extreme commitment...and so does raising a family and having a good and strong relationship with your partner or spouse.

Although the public is absolutely fascinated with famous people’s divorces, no one will know the true story except the two people involved.

At the very least, however, one should recognize that they did NOT go through the court system other than to finalize their divorce.  All that was involved in unraveling their marital and pre-marital assets and liabilities was probably done by a settlement minded professional such as a mediator or collaborative Attorney.

So, if it is good for the “rich and famous” it is DEFINITELY much more economical for “the rest of us”.

"Getting Married Is Like Going To Hell": Why More Young Chinese Are Falling Out Of Love With Tying The Knot.

This article speaks about the decreased numbers of marriages in China due to several reasons, including the extreme cost to get married and have a family as well as the impediments and costs to actually getting divorced. Last year China enacted a 30-day cooling-off period for divorce seekers with the aim of improving social stability.

I don’t believe this reduction is solely in China. I believe many young people are choosing not to get married for multiple reasons, among those which are cited by the Chinese. 

Just because people are choosing not to get married does not mean that they have avoided all the problems that could occur when they cohabitate and share assets and liabilities. Therefore, whether it’s a prenup or a cohabitation agreement, it’s important to have an agreement which outlines ALL of the issues regarding assets and liabilities coming into the relationship.

What It Feels Like For Your Child When You Divorce

Divorce is often traumatic and scary for adults.  From a child’s perspective, it is magnified exponentially.  For young children this has to be devastating and concerning. 

As we have learned over time, divorce affects every child, no matter their age; even those who are adults when their parents divorce (known as a gray divorce).

Many times people think:  children can adapt, they will survive, it will be ok, without taking into consideration the real effects and intensity that a divorce may have on children.  This is a time when they need even more attention and support.  This is a wonderful article that highlights the concerns for children and how to try best to serve them during this traumatic time.

Proud to have participated on a panel today speaking at the New York State Bar Association’s (NYSBA) Annual Meeting on LGBTQ Issues in ADR (Alternative Dispute Resolution) and how our community is better served by ADR!

LGBTQ+ issues have arisen more and more frequently in arbitration and mediation. Those issues include implicit bias of the arbitrators and mediators, and involve workplace issues, family law matters, trusts and estates, among others.

Want To Get A Divorce? Here's What To Do First, According To Lawyers

As I have stressed many times in the past, alternative disputed resolution processes, such as Mediation and Collaborative Divorce, are the better paths to take to resolve conflicts outside the court system.  Notwithstanding what these lawyers think, you should first research a divorce lawyer...my suggestion is to first look into alternative disputes professionals like mediators and collaborative divorce attorneys.  I would even go so far as to seek out a collaborative divorce lawyer first, since if you are not aware of how the processes work, you will at least get the perspective of what happens in litigation verses mediation and collaborative divorce.  They can help guide you on what is best for you and your family.

Here's What Parents Should Know About Minimizing The Impacts of Divorce - From A Divorce Attorney Who Represents The Kids

Once again, I always urge people to seek the processes of mediation and collaborative divorce, not only for a more holistic approach to their dissolution of their marriage, but to save their children and family from the severe impacts of a litigated divorce.  The collaborative process includes a mental health professional who acts as a family specialist to help a family sort through the issues regarding their children, custody and parenting time.

This article also speaks about how this attorney represents children and gives them a voice in the court system.  What I would suggest to you is that having to put your children in the hands of an attorney to begin with is in and of itself a traumatic experience for a child.  If you really want to consider avoiding the impacts of divorce on your children, you need to think of the alternative dispute resolutions of mediation and divorce that will protect children from the traumas of divorce.

As depicted by Michelle Obama’s brutal honesty, marriage is work and not always 50/50.  It's more of a pendulum that changes from time to time; one giving more at one point and one giving less at another point, but the bottom line, as she depicts, is that you have must be prepared to be truly uncomfortable and recognize that a marriage is difficult work and there will be times where there will be arguments.  It's how you handle those arguments and move forward that matters...and compromise plays a big role.  This article also poses some important questions for a couple to consider.

Kathy Whitworth, The Winningest Golfer in History, Dies at 83

I find it amazing how many times there are exceptional women in sports and in other areas who have broken records but are never included in conversations when they talk about the best records and male achievers.  Here is a perfect example:

Kathy Whitworth is the winningest golfer in history - period - for men and women - but most people don’t even know who she is because everyone talks about Tiger Woods and all of the other male greats, without giving recognition to a woman who has done just as well or better.

Her 88 wins are 6 more than Sam Sneed and Tiger Woods, who hold the record for the men’s game.

As this article depicts, Kathy was a champion in the truest sense of the word, both on and off the golf course.  She was an inspiration to many women, and was amazingly kind and generous, not only with her time but also in sharing her skills.
