More Than Two Dozen States Were Expected To Ban Abortion Post-Roe. Courts Are Keeping It Legal In Several Of Them

As a follow up to my post last month, it has been a year since Roe v Wade was stricken and eliminated the Federal constitutional right to abortion nationwide.  More than a dozen U.S. States have banned or severely restricted access to the procedure.  However, abortion remains legal in 7 states that were expected to ban abortion after Roe was overturned; including Michigan where voters approved a measure to ensure abortion rights in their state constitution.

State court houses seem to have emerged as the battleground for both protecting and restricting access to abortion.  Forty lawsuits challenging abortion bans have been filed in 22 states.  It was believed, prior to the arguments heard on Dobbs v. Jackson, that 26 states were likely or certain to ban abortion.  However, one year later, in 7 of those 26 states, abortion remains legal.
